This is the reply I sent to David and the responses are as below:- From: mikerepair@freenetname.co.uk In regards to payments, I am currently running a check with my bank, as I have appeared to over paid on several occasions in the time spent at the property not only was the payment made by BACS but payments paid in directly to the bank account, I will send you copies of the manual payments via electronic format. You are aware as the landlord I need to see a completion of sale document to verify the sale and to provide this evidence to my solicitor, and that if I am unable to find alternative accommodation, it is required by the landlord to help me find and relocate to alternative accommodation. This is the response from David on 6th December 2006:- Mr Wood, Please find attached my response to your email below. An original has again be sent to both you and Sam King at Spelthorne Council. 4 December 2006 Dear Mr Woods, I am writing in response to your email dated 6th December 2006. I wanted to confirm a few details which you seem to be confused about. 1. The current ownership details of 179 Laleham Road, Staines The house has not been sold, the terms of any sale were dependent on Vacant Possession. As I stated, and you agreed to the date that you would no longer be in the property as Monday 29th January 2007, the exchange and completion has therefore been delayed and will take place after this date. You can therefore inform your solicitor that they should not be concerned about any fraudulent claims, as this isn’t the case here! I have not received any correspondence from Sam King at Spelthorne Council with any requests for information or documentation. 2. Your obligation as a tenant. Unless I am mistaken I don’t believe that anyone can live anyway ‘rent free’, as your notice period is the end of January, I fully expect you to pay rent at the agreed value of £400.00 for November, December and January 2007. As your rent is inclusive, I am not prepared to pay the rates (water, electricity etc) while you reside in the property. The November payment as I stated in our last correspondence has not been paid. I expect payment to be made by Monday 11th December at the latest. 3. Payment Arrears There was an extended period of time when no rent payment was received; the amount of £100.00 is in relation to this. To my recollection there has been no overpayment (as you state in the email). I look forward to receiving the bank records that you mention, as it may well highlight other periods when no payment was received. Again I would be grateful if you could confirm receipt of this letter and its contents and inform me when you will be making your November, December and January rent payments. Yours sincerely,
